Mumbai: MahaRERA Fines Builder Rs 12 Lakh For Advertising Unregistered Projects

Taking serious cognisance of the complaints filed by the Mumbai Grahak Panchayat (MGP), state real estate regulator MahaRERA has slapped Rs 12 lakh penalty on Kabra and Associates for advertising unregistered projects.
In a recent order, the MahaRera has slapped a total penalty of Rs 12 lakh on the builder for violating sections 11 (2) and sections 12 and 14 of the Act. "The builder has violated various regulations of RERA law by advertising unregistered projects. Also, the builder had not advertised in compliance with the rules, which mandate the promoter to prominently display their MahaRERA registered the number and their website address in any ad," said MGP chairman Shirish Deshpande.
As per RERA regulations, once a project is registered, developers cannot make any changes in the proposal without taking consent of two-thirds of the home-buyers, which Kabra had violated while advertising one of his projects. "We brought this to the notice of MahaRERA, acting on which, a total penalty of R12 lakh has been slapped on the builder," Deshpande said.
He further said apart from Kabra, five other developers have also been slapped with a penalty of Rs 2 lakh each for violation of these sections. These builders include Goodtimes, Lashkaria Housing, Rikki Ronie, Ashar Realtors and Puraniks.

The advertisement’s claim, “It is high in protein and fibre” is false as it is not applicable for the serving size of the product and, in the context of a product positioned for weight management, it is misleading by ambiguity.
Also the claim, “Foods high in protein and fibre make you feel full and keep hunger pangs away” – Since this claim is linked to the claim of the product being high in protein and fibre, it is also misleading due to the reasons mentioned above.
Furthermore, the claim was also inadequately substantiated for the specific product being advertised. The claim, “To manage weight eat a breakfast like Kellogg’s Special K”, was considered to be misleading by ambiguity and implication. The visual of the celebrity when seen in conjunction with the claims is likely to mislead consumers regarding the product efficacy as the advertiser was not able to submit any evidence that the celebrity is in agreement with the claims being made in the advertisement in general, and where she claims this to be her experience in particular. This contravenes the Guidelines for Celebrities in Advertising.
Also, the disclaimers in the advertisement were not legible. The heights of the picture area was 386 lines for SD and 1090 for HD. The lowercase elements were measured to be of height of about 7-8 pixels or less for SD and 18-19 pixels for HD formats. The SD clip (provided by the complainant) does not comply whereas the HD clip (provided by the advertiser) does comply with the ASCI Guidelines for Disclaimers Clauses (VII) (i) (1) of ASCI Guidelines for Disclaimers (“For standard definition images, the height of the text lower case elements shall be not less than 12 pixels (12 pixels lines) in a 576 line raster.”) for SD version of the advertisement. 

While the advertiser declares the protein and fibre content per serve size on the product package to enable consumer make an informed decision, such serve specific reference is missing from the TV advertisement. The claim “High Protein”, “High Fibre” does not qualify per serve basis – more so when only one serve of the product is likely to be consumed by a consumer within a day as the product is a “breakfast option”. The claim, “It is high in protein and fibre”, is false as it is not applicable for the serving size of the product and in the context of a product positioned for weight management, it is misleading by ambiguity. The stand-alone claim of “Foods high in protein and fibre make you feel full and keep hunger pangs away” is not objectionable. But when seen in conjunction with “High Protein” “High fibre”, the claim based on 100 gm of product is misleading by implication. While “eating breakfast regularly” as a generic advice for weight management was considered acceptable, the CCC did not consider the claim statement implying “regular breakfast” with the advertised product for weight management to be adequately substantiated. The claim, “To manage weight eat a breakfast like Kellogg’s Special K”, was considered to be misleading by ambiguity and implication. The advertiser provided details of the e:mail correspondence regarding the endorsement statements as agreed by the celebrity (Deepika Padukone) i.e. “Mere jaise, weight manage karne ke liye, eat breakfast every day”, “Stay healthy and eat breakfast every day”. It was noted that the celebrity has not used the product name in her approved statements and that the advertiser is required to be consistent with the celebrity endorsed statements in the advertisement. The disclaimers were not in accordance with the ASCI guidelines.

बैंक,बीमा कम्पनी तथा किसान के बीच क्या है सम्बन्ध ?

प्रधानमंत्री फसल बीमा योजना के 2 वर्ष से ज्यादा हो गये है लेकिन आज भी किसानों के बीच गलतफहमी बनी हुई है | इस कारण किसान अपनी फसल का बीमा कराने तथा बीमा को पाने में दिक्कतों का सामना करना पढ़ता है  अक्सर किसान बीमे की लडाई बैंक से करने लगते हैं | इस बारे में किसान समाधान आप के लिए बैंक, बीमा कम्पनी तथा किसान के बीच का सम्बन्ध है यह बतायेगा |

फसल बीमा में बैंक का क्या भूमिका है ?

बैंक बीमा कम्पनी का एक एजेंट की तरह है | जिसका कम यह है की बीमा कम्पनी के लिए बैंक किसानों के फसलों का बीमा करा सके | इसको इस प्रकार भी समझ सकते हैं A नाम का किसान B नाम के बैंक में बीमा कराने जाता है या बैंक से KCC से कृषि कर्ज लेता है तो बैक B उस किसान का कुल कर्ज का 2% काट लेगा | तथा यह पैसा C नाम की  बीमा कम्पनी को दे देगा और आप को एक फार्म भर कर देगा जिसमें लिखा रहेगा की आप का बीमा किस कम्पनी ने किया है | तथा आपके  फसल बीमा की अवधि क्या रहेगा | बीमा कितने का है | बैंक आप का 2 % तभी कटेगा जब आप कृषि कर्ज खरीफ फसल के लिया है | अगर आप कृषि कर्ज रबी फसल के लिए लिए हैं तो आप का कृषि कर्ज का 1.5% कटेगा तथा बागवानी फसल के लिए 5% कटेगा | यह पैसा C नाम के बीमा कम्पनी को दे देगा |
बैंक B आप को अगर बीमा का प्रमाण पत्र दे देता है तो आप का बैंक से फिर कोई कम नहीं रह जाता है | बैंक का कम सिर्फ इतना ही है | इसके बाद आपको सिर्फ बीमा कम्पनी C से कम रहता है |

बीमा में पटवारी का क्या भूमिका है ?

किसान भाई अगर आप ने बैंक से बीमा का प्रमाण पत्र हासिल कर लिया है तो अब आप का बैंक से कोई मतलब नहीं रह जाता है | लेकिन बैंक बीमा का प्रमाणपत्र नहीं देता है तो आप बैंक से मांगे नहीं देने पर प्रत्येक बैंक में एक बीमा अधिकारी रहता है उससे सम्पर्क करें |इसके बाद जिस फसल के लिए फसल बीमा लिया है उस फसल का बोनी प्रमाण पात्र लेना होगा | इसके लिए आप के भूमि पर पटवारी आकर आप के फसल को देखेगा | तथा आप को बोनी प्रमाण पत्र देगा | अगर पटवारी आप को बोनी प्रमाण पत्र नहीं देता है तो किसान अपना बोनी प्रमाण पत्र के लिए पटवारी से सम्पर्क करें | पटवारी के खेत पर नहीं आने पर किसान अपने तहसील के तसीलदार या अनुभागिय अधिकारी से शिकायत करें | अगर आप ने पटवारी से बोनी प्रमाण पत्र नहीं लिया है तो आप का फसल बीमा में यह माना जा सकता है की आपने कोई फसल बोया ही नहीं हैं |

बीमा कम्पनी और किसान के बीच का सम्बन्ध क्या है ?

किसानों को बैंक से बीमा का प्रमाण पत्र मिल जाने के बाद, पटवारी से बोनी प्रमाण पत्र मिल जाने के बाद अब किसान और बीमा कम्पनी के बीच का सम्बन्ध रह जाता है | अगर आप की फसल खराब हो गयी है तो इसकी शिकायत बीमा कम्पनी के पास करें तथा अपने तहसील के SDM के पास करें | तथा बीमा का लाभ लें
