Ravi Shankar Prasad: Dear Sir , Given your concern about reducing judicialburden you know that every matrimonial case in India has at least 3 to 4 independent cases running only for extracting maintenance from the husband ? Before uniform civil code we need a "Uniform Maintenance Code" to reduce the sheer volume of cases.
Why do we have 4 separate laws for paying maintenance to women. ?
a. DV Act 2005 ( Interim and Permanent Maintenance)
b. CrPC 125 ( Interim Maintenance )
c. HMA 24 ( Interim Maintenance )
d. HMA 25 ( permanent Alimony)
e. Arm twisting husbands to pay against bail proceedings in
a false 498a.
2. If paying maintenance is the ultimate goal why does India spend thousands of cores on women's education. The outcome of this massive investment seems to be not in a reduction but an increase in maintenance cases. Does law ministry have an explanation for this ?
2. Maintenance cannot be tax free and has to be taxed at hands of the receiver. Women demand and receive lakhs/crores of rupees and not pay a dime in taxes.
3. Make divorce less lucrative for women or the Hindu family system as we know it will be finished in a generation or two.
